I hear Judge Jan Goldsmith has gotten annoyed with families fighting him and his wife Christine Goldsmith as a judge that he is putting his hat in for San Diego city attorney. I can't believe how dirty and slimey these judges get and get turning to do more damage to our community. Check him and his wife out on http://ratethecourts.com search for Jan and Christine Goldsmith and see for yourself. It seems that Jan made some threats to http://ratethecourts.com and got them block out the comments. If they weren't true, then why is he so concerned? Is he worried about his judicial misconduct case that he has had to take a leave of absence from the bench because too many people have wised up and don't want him as a judge. Parential rights groups have exposed this judge. he attacks family rights activists and as a state assemblymember he was rated as anti-family. Check out the facts for yourself and make sure this guy does not get elected.

Touchy Feely Pushed On Poway Teachers
PROMINENT MOLE ARRESTED!

Why was pro-life/family activist Connie Youngkin arrested twice in 1995 for attending Poway Unified School District teacher training sessions?

In 1995 the district began holding workshops for teachers and administrators, on how to hold "support groups" for children. Under discussion at the meetings has been the book Conducting Support Groups for Elementary Children K-6 by Jerry Moe. After reading the book and attending some of workshops, Youngkin complained that the material is anti-family and that the support group procedures constitute psychological counseling and should be conducted by licensed therapists, not schoolteachers. In 1995 Youngkin knew the book was being used as a teachers manual for the support groups at Tierra Bonita Elementary and Garden Road Elementary. She suspects it is used in more schools now, because of the district's 1995 push of Moe and his book.

Youngkin says the permission slips sent home to parents state that children will participate in groups to help them with "positive decision making" and "self-esteem." She says hiding the nature of the program is advised by Moe in his book. Page 131: "t is generally prudent not to allow children to take home any work they do in the support group -- art, collages, related items. This will ensure that none of the children's creations will risk becoming the focus for derision or anger, or be used against them in any other way."

Page 25: "During some group meetings, children will be taking a look at parts of their lives they may rather not expose, like chemically-dependent family members, divorced parents, or their own self-defeating behaviors. Such explorations can be painful for them as they unlock an array of uncomfortable feelings."

Page 104: "As the group chants, the child slowly turns around, showing the feeling that he or she whispered to you, and the group members try to guess the feeling. Once correctly identified, ask the child to share a time he or she experienced that particular feeling."

Youngkin notes that a key element in the support group program is the promise the students make to keep their discussions secret. Youngkin wonders whether young children are capable of observing confidentiality and what harm would be done by gossiping about problems exposed during sessions.

Youngkin attended a March, 1995 teachers seminar about this program. When she attempted to attend another seminar on April 3, 1995 at which Moe spoke to district staff (one teacher represented each school), she was arrested. According to Youngkin, Moe stressed the importance of working with younger children, "because they're more open and their defenses aren't built up as much."

At that session, about 45 minutes into Moe's talk, Sharon Jahn, the district's Wellness Coordinator, called an unscheduled break. After the teachers left the room, Youngkin, who had been sitting in the back taking notes, was arrested by two police officers, who carried her out of the room in her chair.

Youngkin attended a workshop in May, 1995 but was not arrested. When she attended a session at Bernardo Heights Middle School on August 8, she was again arrested, in spite of the district having been advised by its attorneys on August 3 that it cannot keep some citizens out of teachers' meetings, while allowing others (at the August 8 arrest, Poway School Board member Kathleen Zaworski-Burke was present). The August 3 letter from attorney Clifford Weiler to superintendent Robert Reeves stated the district could keep teacher meetings secret from parents and school board, but at meetings where they allow the public, "the group/sponsor cannot let in some members of the public and exclude others."

At the August 8 meeting, Youngkin insisted that she be allowed to attend, because, "I paid for this meeting with my taxes." She and her friend, Cyndi Ottle, managed to get into the meeting against Sharon Jahn's wishes (the school principal arrived late and unwittingly unlocked the door for them). Sharon Jahn contacted police, who arrested Youngkin and Ottle (saying they were conducting a citizen's arrest for Leslie Fausset, an assistant superintendent), though the two women agreed they would leave and not return. Kathleen Zaworski-Burke remained at the meeting, later telling Youngkin the material presented was "disturbing."

After the arrest, the San Diego City Attorney's office prepared a report, determining that, because a school board member attended the meeting and because the instructor invited Youngkin and Ottle to participate (when she noted them sitting at the side of the room), "there is no reasonable likelihood of conviction" for the arrest. The report added, "Moreover, it would probably appear to a jury that the school district was acting unfairly toward Defendant by excluding her from these teacher training sessions after they had let her attend an earlier session and had previously let other concerned community members attend the training sessions."

Assemblyman Steve Baldwin, chairman of the state assembly education committee, says he has been contacted by numerous parents and teachers in the Poway school district, complaining about the support groups. He has collected documents about the Poway program from parents and from teachers. He says he has had the materials reviewed by psychologists, who regard the program as "dangerous and inappropriate," because teachers are not trained counselors. He notes that the school district has been secretive about the program; lately the district has been collecting teacher hand-outs at the end of training meetings.

Two bills before the California legislature would put an end to programs like this. AB 2820, written by Baldwin and carried by Scott Baugh, expands parental rights, allowing children to be opted out of psychological exercises (as is the case with sex education) and mandating that parents be allowed to observe classrooms and teacher training meetings, and review all school materials, including teachers manuals. AB 3188, carried by George House, forbids the use of psychological techniques by school teachers. This bill is supported by the American Psychologists' Association. Both bills, however, are opposed by the California Teachers' Association, the National Education Association, and the California Department of Education.

Both bills have passed the Education Committee, and Baldwin expects them to pass the Appropriations Committee and be voted on by the Assembly by the end of May. Baldwin says that Assemblyman Jan Goldsmith (former mayor of Poway) will likely receive pressure from Poway schools to vote against the bills.

This November, two members of the Poway School Board will be up for re-election -- Kathleen Zaworski-Burke and Charlene Zettel. Connie Youngkin describes Zettle as one of the four board members who "just agrees with whatever the district wants." She characterizes the reaction of these board members to her allegations as: "It may be in the manual, but of course our teachers aren't doing that."

Judge Jan Goldsmith
Adjunct Professor of Law
Judge Jan Goldsmith was appointed to the San Diego Superior Court in December 1998. Prior to his appointment to the bench, Goldsmith served  three terms in the California State Legislature representing San Diego County. During his career in the Legislature, Goldsmith held various leadership positions including Majority Floor Leader, Assistant Minority Leader, member of the Rules Committee and Chairman of the Committee on Banking and Finance. Among other awards, Goldsmith received special recognition from the Childrens Lobby- affiliated with USD Law School- for his legislative work on behalf of foster children.

Before his election to the Legislature, Goldsmith held office as Mayor of the City of Poway and before that Poway City Councilman. During 1988-1998 Goldsmith was a successful candidate in eight  elections for public office including primaries. His last election was in 1998 when he ran for statewide office and was unsuccessful in his bid to become California State Treasurer.

Judge Goldsmith retired from the political world in 1998 when he was appointed to the bench, choosing instead to share with students a blend of politics and law in his class, Law & Political Process, which he has taught in various law schools since 2001.

Admitted to the State Bar of California in 1976, Goldsmith graduated  from the University of San Diego School of Law that same year.  He began his legal career with Seltzer,Caplan, Wilkins & McMahon and eventually established his own law firm specializing in business litigation.

This is judge Goldsmith's ratethecourt.com comments. He is rated an "F" but his comments were removed by the administrator because he threaten to sue them.

Judge Goldsmith is under investigation for judicial misconduct and has taken a leave of absence from the bench. He is giving his try at running for SD City attorney and has received the endorsement of the SD republican party. This judge is unfair to families and children. He has set the record for destroying children's homes and placing more children in foster care than any other judge in San Diego County. His wife is Judge Christine Goldsmith and is equally harmful to families and children. Their belief is that if you are going to submit your family to the court, you are going to pay until your are drained of your wealth, then your are going to further pay by losing your children because the country gets federal incentives to remove children and relocate them in foster homes. Don't vote for this scumbag, he and his wife are absolute scumbags.  2007-12-10

I was at the Republican Party meeting the other night and Jan Goldsmith was speaking again after he gave another large donation to the party to allow him to speak.  He was bragging that he was a "hanging judge" and put people away even when they were innocent and everyone laughed.  He bragged that he would stop the investigations that Aguirre is doing and get him "evacuated out of office like a turd."  I don't know if he was making a racial slur since Aguirre is Latino but the slogan sounded that way.  He wanted to project that he was a good old boy and will do politics as usual and sell out to the highest bidder.

Casey Gwinn former San Diego City Attorney confirms that Judge Jan Goldsmith is allegely a wifebeater.  The incident happened over 20 years ago with his wife Christine Goldsmith that is forced to live in fear of her husband on a daily basis.  Casey only hopes that she will see the light and leave this angry and evil man.  Casey remarks that Goldsmith has an angry temper and often loses his cool when asked at a breakfast meeting.

Dirty City Attorney and Judge Jan Ira Goldsmith says tax the poor by charging for garbage and other fees that should be free of charge.  Another way to cheat and screw low income people to charge us for services that our tax should pay for.  Private trash companies make more money by recycling.  Why doesn't the cite does this?

YOU ESTABLISHED WHEN YOU CAMPAIGNED FOR CITY ATTORNEY THAT YOU WOULDN'T TRY TO SET POLICY AND THAT YOU WOULD INTERPRET THE LAW. NOW, LAST WEEK YOU LAID OUT A PLAN TO PRIVATIZE TRASH COLLECTION AND CHARGE SAN DIEGO HOMEOWNERS. HOW IS THAT NOT POLICY.

IT'S NOT BECAUSE IT WAS AN OPTION THAT HAD NEVER BEEN CONSIDERED OR THOUGHT OF IN THE CITY OF SAN DIEGO. YOU KNOW SOMETHING, I SAID THAT THE CITY ATTORNEY'S OFFICE IS A THINKING OFFICE. IT HAS TO BE A WATCH DOG BUT NOT A SCARE CROW. SO, WE STOP THINGS WHEN WE SEE THEM GOING WRONG ON A LEGAL BASIS AND COME UP WITH IDEAS AND OPTIONS. WHEN I GO BEYOND THAT AND MAKE IT A CRUSADE, THAT'S WHEN YOU ARE STEPPING INTO POLICY. WE PUT AN OPTION DOWN ON THE TABLE THAT HAD NOT BEEN CONSIDERED. IT'S UP TO THE POLICYMAKERS WHETHER THEY WANT TO CONSIDER IT.

I DON'T THINK ANYBODY WHO IS AN ELECTED OFFICIAL IN THE CITY OF SAN DIEGO CAN GO ON A CRUSADE. ISN'T THAT AGAINST THE LAW? CAN THE CITY COUNCIL OR MAYOR OR YOU CAMPAIGN FOR SOMETHING.

AS FAR AS LOBBYING THE CITY COUNCIL AN PROPOSING IT AND MAKING IT AND IDEA THAT THE CITY COUNCIL SHOULD A DEVELOPMENT, THAT'S WHAT I MEAN BY A CREWS SAID. I HAVE NOT SAID AND WON'T SAY THAT THE CITY COUNCIL SHOULD A DEVELOPMENT THAT PROPOSAL. I SAID THIS IS AN ADDITIONAL OPTION. THEY HAVE A LIST OF OPTIONS THAT WERE SET OUT BY THE INDIANA BUDGET ANALYSTS. THAT WASN'T ON THE LIST. THE CHARTER --WE GO BY THE CITY CHARTER. THIS IS A GREAT BOOK. THE CITY CHARTER SAYS THAT THE CITY COUNCIL CAN GET US OUT OF PROVIDING ANY SERVICE, CAN ELIMINATE ENTIRE DEPARTMENTS. THEY GET TO DECIDE THAT. THAT'S WHAT THIS IS ABOUT, THE IDEA THAT THE CITY CHARTER ALLOWS THE CITY COUNCIL TO PRIVATIZE JUST ABOUT ANYTHING, NOT SOME OF THE CONSTITUTIONAL OFFICES BUT THEY CAN DO THAT. THERE IS A TRAIN BETWEEN THE CITY CHARTER AND THE PEOPLE'S ORDINANCE. WE RAISED THAT.

THAT'S WHAT I WANT TO TALK ABOUT. THE PEOPLE'S ORDINANCE, THE CITY LAW ON THE BOOK FOR 90 YEARS IS SUPPOSED TO PROTECT HOMEOWNERS FROM TRASH COLLECTION CHARGES.

NO?

NO. THAT'S ONE OF THE THINGS IN OUR MEMORANDA OF LAW, THERE IS A LOT OF THESE SAN DIEGO MYTHS, A FEW THAT 1919 CITIZENS ROSE UP WITH PITCH FORKS AGAINST THE CITY AND SAID NO MORE CHARGES AGAINST TRASH. NOT TRUE. WE DID THE RESEARCH. IN 1919 THERE WERE PRIVATE TRASH HAULERS CHARGING CITIZENS PICKING UP THE TRASH, SELLING IT TO THE HOG FARMERS AND MAKING A BUNDLE. THE CITIZENS ROSE UP AND SAID WE WANT OUR CITY TO PICK UP THE TRASH AND MAKE THE MONEY, APPLIES, IN THAT ORDINANCE IT REQUIRED THE CITY TO CHARGE A TRASH TAX. NOBODY REALLY KNOWS THAT BECAUSE THEY DIDN'T DO IT.

ARE YOU THE FIRST PERSON TO HAVE RESEARCHED THIS AND FOUND IT OUT?

OUR OFFICE DID RESEARCH IT BECAUSE WE LOOKED AT THINGS BETWEEN THE CITY CHARTER AND THE PEOPLE'S ORDINANCE. IT REQUIRED A TRASH TAX. BECAUSE THE CITY MADE SO MUCH MONEY TO THE HOG FARMERS, THEY DIDN'T CHARGE A TAX. THE CITY OF SAN DIEGO TRADITION, THEY IGNORED THE LAW.

WILL THIS FLY WITH THE CITY COUNCIL.

IN THE 1980s, THE CITY COUNCIL CHANGED THAT AND OFFERED FREE TRASH PICK UP FOR ONLY SINGLE FAMILY HOMES UNDER THE CRITERIA.

YOU DON'T KNOW IF THE CITY COUNCIL WILL PICK UP ON IT. THEY WOULDN'T HAVE TO PUT IT ON THE BALLOT?

THEY WOULD BECAUSE OF THE STRAIN OF THE AMENDED PEOPLE'S ORDINANCE IN THE 1980s WITH THE CHARTER. OR IF YOU CHARGE A TRASH FEE. THEY HAVE PLENTY OF OPTIONS. SALES TAX, OPTION OF PRIVATIZATION.

THINK ABOUT WHAT THAT BALLOT IS GOING TO LOOK LIKE IF THEY'VE ALREADY SAID THEY ARE PUTTING IN NEW CITY HALL WHICH WOULD BE TAXPAYER FUNDED ON THE BALLOT. IF THEY PUT THE TRASH TAX THING ON THE BALLOT. IF THEY PUT, FOR EXAMPLE, AN INCREASE IN THE CITY SALES TAX ON THE BALLOT. SO, THE VOTERS HAVE TO LOOK AT ALL THESE THINGS. WHAT ABOUT CHARGE ERSTAD YUM. WHAT ABOUT AN EXPANSION OF THE CONVENTION CENTER.

THAT IS FOR THE COUNCIL AND MAYOR TO THINK IN TERMS WHETHER THEY WANT TO PUT SOMETHING ON THE BALLOT. THAT'S WHERE I OVERSTEP MY BOUNDS. I CAN GIVE THEM OPTIONS. THEY CAN CONSIDER IT.

THERE ARE FEES THAT WE ARE DOING. OUR OFFICE IS FIGHTING FOR PENSION REFORM. WE CAME UP WITH AN OPTION THAT WASN'T CONSIDERED BEFORE AND WE ARE WINNING.

THIS JULY, THIS MONTH, WE SAVED THE CITY $6.1 MILLION IN PENSION PAYMENTS UNDER NEW IDEAS THAT WE RAISED IN COURT. I THINK THAT WE WILL KEEP DOING IT.

ONE FINAL QUESTION. WE HAD THIS TERRIBLE STRATEGY STRIKE THE 2-YEAR-OLD BOY A FEW DAYS AGO, SWALLOWED AND CHOKED ON A GUM BALL. THERE WAS A DELAY BECAUSE OF THE BROWN OUT POLICY FOR FIRE AND RESCUE TO GET THERE. SO, NOW, THERE IS A PUSH TO CANCEL THE BROWN OUT POLICY. IS THAT POSSIBLE? CAN THE CITY AFFORD TO DO THAT?

IT'S POSSIBLE BECAUSE THEY CAN SET FUNDING PRIORITIES AS THEY SEE FIT. I DON'T KNOW WHETHER THE BROWN OUT CAUSED IT. BUT, IT DOES --IT'S REALLY SAD BUT IT UNDER SCORES THE SERIOUSNESS OF WHAT WE ARE TALKING ABOUT. OUR CITY CHARTER SAYS THAT POLICE ARE SUPPOSED TO BE THE HIGHEST PRIORITY IN FUNDING. YOU ADD IN FIRE AND PUBLIC SAFETY AND THESE ARE SERIOUS DECISIONS ON FUNDING PRIORITIES THAT THEY CAN TAKE ANOTHER LOOK AT AND THEY CAN ADJUST THE PRIORITIES.
